Terms of Service

These Terms of Service (“Terms”) govern your use of the SyncIn website at syncin.pro and the SyncIn service (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

SyncIn is a message synchronisation service that connects your WhatsApp and LinkedIn messaging accounts (via Unipile) to your CRM. The Service automatically logs incoming and outgoing messages as engagements in your CRM account.

SyncIn acts as a pass-through — we receive message data from your connected platforms, match it to the appropriate contact, and create a record in your CRM. We do not modify, filter, or analyse message content beyond what is necessary to deliver it to your CRM.

2. Account Registration

To use SyncIn, you must:

• Be at least 16 years of age
• Provide a valid email address
• Create a secure password
• Provide valid credentials for your messaging platforms and CRM account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. User Responsibilities

By using the Service, you agree to:

• Comply with the terms of service of WhatsApp, LinkedIn, and your CRM provider
• Ensure you have the right to process and sync the messages passing through your accounts
• Provide accurate and up-to-date account information
• Notify us immediately if you suspect unauthorised use of your account
• Use the Service only for lawful purposes and in compliance with applicable data protection laws

4. Acceptable Use

You may not use the Service to:

• Send spam or unsolicited messages
• Violate the rights of any third party, including privacy and intellectual property rights
• Transmit malware, viruses, or any other harmful code
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service in any way that could impair its performance or availability

5. Intellectual Property

All content, trademarks, and intellectual property related to SyncIn (including the website, logo, and software) are owned by SyncIn or its licensors. You may not copy, modify, or distribute any part of the Service without our prior written consent.

You retain ownership of all data you provide to the Service, including your messages and CRM data. We do not claim any ownership over your content.

6. Service Availability

We strive to provide a reliable service, but SyncIn is provided on a best-effort basis. We do not guarantee:

• 100% uptime or uninterrupted service
• That all messages will be synced successfully (third-party API failures, rate limits, or webhook delays may affect delivery)
• Specific response times or processing speeds

We may perform maintenance, updates, or modifications to the Service at any time. We will endeavour to provide advance notice of any planned downtime.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• SyncIn is provided “as is” and “as available” without warranties of any kind, whether express or implied.
• We are not responsible for the content of messages synced through the Service. SyncIn acts solely as a pass-through.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Account Termination

You may delete your account at any time from your Settings page. Upon deletion, all your data will be permanently removed from our systems.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice. In the event of termination for cause, you will not be entitled to any refund.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal data.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of the Netherlands. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
